What Happens When A Committee Member Resigns? – NSW

A committee member may resign for many reasons – the sale of the property, other commitments, even just a need for a change.

If the committee member decides not to wait until the annual general meeting to stand down, there are procedures that have to be followed to ensure the owners corporation runs smoothly.

The quickest and easiest way to fill the vacancy is to have another member of the owners corporation fill the vacancy in an ‘acting capacity’. This can be done by passing a motion by the executive committee. Source: section 35(2) of the Strata Schemes Management Act 2015 (the Act)

Alternatively, the vacancy could be filled by holding vote on the new appointment at a general meeting of the owners corporation.

The newly appointed (or elected) committee member holds office only until the annual general meeting where all committee members are required to be elected.

However, if the resignation of the member leaves the committee unable to form a quorum, the committee must call a general meeting.
